1. Introductory Provisions

These Terms and Conditions (hereinafter referred to as the "Terms and Conditions") of My Culinary s.r.o., with its registered office at Výstaviště 405/1, Brno 603 00, Company ID: 05421730, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, Insert 100243 (hereinafter referred to as the "Seller"), govern in accordance with the provisions of Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the "Civil Code"), the mutual rights and obligations of the contractual parties arising in connection with or on the basis of a purchase contract (hereinafter referred to as the "Purchase Contract") concluded between the Seller and another legal entity or natural person (hereinafter referred to as the "Buyer") through the Seller's online store or a third-party intermediary designated by the Seller, www.gault-millau.cz.

These Terms and Conditions and the Complaints Procedure define and specify the rights and obligations of the Seller and the Buyer in the sale of tickets for any cultural, social, sporting, or other events (hereinafter referred to as the "Event") organized by the Seller.

These Terms and Conditions form an integral part of the Purchase Contract concluded between the Buyer and the Seller, and by purchasing tickets, the Buyer confirms that they have read these Terms and Conditions and expressly acknowledges that they form part of the contractual agreement between them and the Seller.
2. Subject of the Contract

The subject of the contract is the Seller’s obligation to deliver tickets (electronically) to the Buyer for the chosen Event in the quantity requested by the Buyer, and the Buyer’s obligation to pay the admission fee for the tickets.

The Purchase Contract is concluded upon payment of the admission fee by the Buyer.

After payment of the ticket price by the Buyer, the Seller shall deliver the tickets electronically within a reasonable period to the email address provided by the Buyer. The Buyer is not entitled to receive the tickets before the ticket price for the Event has been paid in full to the Seller’s bank account.

By delivering the tickets to the Buyer’s email address, the Seller’s obligations under the Purchase Contract are deemed fully fulfilled.

Tickets are sent exclusively in electronic form to the email address specified by the Buyer in the ticket order.
3. Rights and Obligations of the Contractual Parties in Relation to the Event

The Seller is the organizer of the individual Events for which tickets are sold. By purchasing a ticket for the Event, a legal relationship arises between the Buyer and the Seller as the Event organizer. The Seller is responsible for fulfilling the obligations of the Event organizer arising from the contractual relationship between the Buyer and the Seller.

By purchasing a ticket, the Buyer agrees to comply with the rules established by the Seller as the Event organizer. Furthermore, the Buyer agrees to comply with the operational and visitor rules of the Event venue.

The Seller, as the Event organizer, reserves the right to change the program, date, and venue of the Event. By purchasing a ticket, the Buyer acknowledges this right of the Seller.

The Seller is not responsible for the validity and authenticity of tickets purchased outside of the Seller’s website.
4. Ticket Purchase Procedure and Payment Terms

The price for each ticket is indicated individually for each Event. Any additional fees associated with the ticket purchase are also indicated for each Event.

When purchasing a ticket through the website, payment is possible only by credit card that allows online purchases, or by bank transfer to the Seller’s bank account.

The Seller is not responsible for any costs incurred by the Buyer in connection with the ticket purchase arising from the contractual relationship between the Buyer and the bank that issued the credit card or maintains the Buyer’s bank account used to pay the admission fee.

Tickets are not sent by cash on delivery.
5. Withdrawal from the Contract

In accordance with Section 1837(j) of Act No. 89/2012 Coll., the Civil Code, as amended, the Buyer has no right to withdraw from the contract concluded between the Buyer and the Seller under Section 1829 of the Civil Code (withdrawal within 14 days without giving reasons), as the contract concerns leisure activities and the performance is provided by the entrepreneur, i.e., the Event organizer, at a specified date.

If the Event date is canceled and a new date is set, tickets remain valid for the new date.
6. Complaints Procedure

All complaints regarding tickets purchased via the website are governed by these Terms and Conditions and the complaints procedure set forth in this Article 6.

The Buyer is entitled to a refund of the ticket price only in the cases and under the conditions specified below.

The Buyer is not entitled to exchange a ticket. In the case of damage, destruction, loss, theft, or other devaluation of the ticket, the ticket will not be replaced and the Buyer will not be compensated.

The Seller accepts no responsibility if the ticket is not delivered to the Buyer due to reasons attributable to the Buyer, in particular if the ticket cannot be delivered to the email address provided (e.g., full inbox, spam filter, etc.).

If the Buyer does not receive the ticket no later than 5 hours after full payment of the admission fee (i.e., after the full purchase price of the ticket has been credited to the Seller’s account), the Buyer must immediately, but no later than within 48 hours from the expiration of the above delivery period, contact the Seller and inform them that the paid ticket has not been received. For these purposes, the Buyer must provide the Seller with the name and email entered as contact/identification details when purchasing the ticket. If the Seller verifies that the ticket was indeed not delivered to the Buyer, the following procedure applies:
a. The Seller undertakes to resend the ticket to the Buyer’s email address within 24 hours, but no later than 1 hour before the Event;
b. If the Event has already taken place, the Seller undertakes to refund the paid admission fee to the Buyer no later than 14 days from the date of the complaint. -
If the Event is fully canceled by the Seller as the organizer, the Buyer who has provided their contact details (email, phone, postal address, fax, etc.) will be notified through this contact information. The Seller is not responsible if the Buyer cannot be reached in time or if the Buyer receives the timely notification with a delay.

If the Event is fully canceled by the Seller as the organizer, the Seller will refund the admission fee in full as described below.

If the conditions for a refund under paragraph 7 of this complaints procedure are met, the admission fee will be refunded via the same payment method used by the Buyer (payment card or bank account). The full ticket price will be refunded no later than 14 days from the date the Event was canceled. Only the ticket price is refundable. The service fee is non-refundable.

8. Personal Data Protection

The Seller processes the Buyer’s personal data for the purpose of fulfilling the contractual relationship between them, pursuant to Article 6(1)(b) of Regulation (EU) 2016/679 (GDPR), to the extent provided by the Buyer; typically: name, surname, email address, phone number, and bank account or payment card number. The minimum data required as a condition for contract conclusion are: name, surname, and email address. Bank account or card numbers are recorded only in the Seller’s accounting on bank statements and are not further processed.

Specific purposes of processing personal data include:
a. delivering the ticket to the Buyer and sending information about changes to Events or tickets;
b. identifying the Buyer in case of complaints according to the complaints procedure in Article 6. -
The Buyer enters their personal data through the website and intermediary software. In the case of incorrect data entry (e.g., typo in name or phone number), the Buyer is obliged to contact the Seller. The Seller retains personal data for the necessary period, but no longer than 12 months, after which the data is deleted. If the Buyer wishes the information to be deleted earlier, they may contact the Seller and request deletion.

Photos and short audio-visual recordings are taken at Events by the Seller as the organizer for the purpose of promoting Events online. The Seller strives to protect visitors’ privacy as much as possible. If the Buyer finds themselves clearly identifiable in such material, they may contact the Seller and request technical measures to anonymize them.

The Buyer may contact the Seller or the Office for Personal Data Protection at any time with requests or complaints regarding the processing of their personal data.
9. Final Provisions

If any provision of these Terms and Conditions or Complaints Procedure proves to be invalid or ineffective, the validity and effectiveness of the remaining provisions shall not be affected, provided that they are severable.

The Seller may amend these Terms and Conditions at any time.

All provisions of these Terms and Conditions, the Complaints Procedure, and the contractual relationship between the Buyer and the Seller are governed by Czech law.
